Terms of Service

These terms govern access to and use of the LogiSkanner marketplace. They are written to define the platform role clearly, reduce avoidable commercial ambiguity, and protect the operator from being treated as the performing carrier, warehouse operator, or customs/handling contractor unless expressly agreed in writing.

Strong business-protective baseline. Final legal counsel review is recommended before external production launch.

Platform role only

LogiSkanner operates as a technology-enabled marketplace, lead-routing service, and vendor discovery platform. Unless LogiSkanner expressly signs a separate written agreement stating otherwise, LogiSkanner is not the carrier, warehouseman, freight forwarder, customs broker, bailee, exporter, importer, insurer, or principal service provider for any shipment or storage engagement.

No guarantee of vendor performance

Vendor listings, ratings, response indicators, and service information are intended to assist discovery and comparison. Final rates, service scope, compliance status, temperature control performance, cargo handling discipline, insurance coverage, storage practices, and delivery execution remain the responsibility of the selected vendor and the contracting user.

User due diligence

  • Users must independently verify vendor suitability for cargo, route, temperature band, compliance, and commercial fit before booking.
  • Users remain responsible for cargo declarations, documentation, and accuracy of submitted requirements.
  • Users should not rely solely on marketplace summaries for final operational decisions.

Vendor responsibility

Each vendor is solely responsible for its licences, permits, insurance, equipment readiness, temperature integrity, handling practice, statutory compliance, personnel, subcontractors, and actual service performance. Vendor participation on the platform does not create any agency, employment, partnership, or joint venture with LogiSkanner.

Indicative prices and content

Any pricing, rates, response times, availability signals, or performance indicators shown on the platform are indicative unless expressly confirmed in writing by the relevant vendor. Content may change due to capacity, seasonality, route disruption, operational constraints, or vendor-side updates.

Limitation of liability

To the maximum extent permitted by applicable law, LogiSkanner will not be liable for cargo loss, spoilage, temperature excursion, service delay, detention, rejection, demurrage, handling damage, customs consequence, indirect damage, special damage, business interruption, or loss of profit arising from any vendor engagement or marketplace use. Where liability cannot lawfully be excluded, LogiSkanner’s aggregate liability will be limited to the lower of the amount paid directly to LogiSkanner for the relevant platform service in the preceding three months or INR 5,000.

Indemnity

Users and vendors agree to defend, indemnify, and hold harmless LogiSkanner, its operator, team members, and affiliates from third-party claims, losses, penalties, damages, costs, or proceedings arising from their cargo, documentation, legal non-compliance, shipment instructions, vendor conduct, or misuse of the platform.

Suspension and removal rights

LogiSkanner may suspend, restrict, edit, remove, or reject any listing, account, enquiry, or content where it reasonably believes there is compliance risk, fraud risk, operational harm, abusive conduct, repeated non-response, false information, expired documents, or risk to platform reputation.

Compliance position

Users and vendors remain responsible for compliance with all laws applicable to their cargo, industry, route, documentation, export/import activity, food handling, pharmaceutical standards, tax requirements, and temperature-sensitive goods. Platform display of a vendor or support response does not amount to legal or regulatory certification by LogiSkanner.

Governing law

These terms are intended to be interpreted under the laws of India, subject to any mandatory local law that cannot lawfully be excluded. Formal jurisdiction, notice, and operator details should be completed by the platform operator before public commercial launch.
